Welcome to Ninety Nine for the One Co. (“Company,” “we,” “us,” or “our”). By visiting our website, placing an order, or using our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not access or use the site.

1. Eligibility & Use of Site

By using this site, you represent that:

You are at least the age of majority in your jurisdiction
You are providing accurate, current, and complete information for all purchases
You will not use our products or services for unlawful or unauthorized purposes

We reserve the right to terminate service to anyone for violation of these Terms.

2. Products & Availability

All products are subject to availability. We reserve the right to:

Limit quantities purchased per order or per customer
Discontinue products at any time
Modify product descriptions, images, or pricing without notice

Certain items are fulfilled in-house, while others are fulfilled through third-party providers, including Printful.

3. Pricing, Billing & Payment Authorization

All prices are listed in U.S. dollars unless otherwise stated.

By submitting payment information, you:

Represent and warrant that you are authorized to use the payment method
Authorize Shopify Payments and its payment processors to charge your payment method for your order total, including applicable taxes and shipping

We reserve the right to correct pricing errors and cancel orders placed under incorrect pricing, even after payment has been processed.

4. Order Acceptance, Fraud Prevention & Cancellation

We reserve the right to refuse, cancel, or limit any order for reasons including but not limited to:

Product availability
Errors in pricing or product descriptions
Suspected fraud, abuse, or unauthorized transactions
Chargeback history or violation of these Terms

If payment has already been captured, any approved cancellation will be refunded to the original payment method in accordance with our Return Policy.

5. Shipping & Delivery

Shipping timelines, fulfillment methods, and costs are outlined in our Shipping Policy, which is incorporated into these Terms by reference.

Delivery dates are estimates only and not guaranteed. Once an order has been transferred to the carrier, Ninety Nine for the One Co. is not responsible for:

Carrier delays
Lost or stolen packages
Packages marked as delivered but not received

Shipping fees are non-refundable.

6. Returns, Refunds & Chargebacks

All returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference.

By completing a purchase, you acknowledge and agree that:

Returns must be requested within 60 days of purchase
Customers are responsible for return shipping costs, except in verified cases of damaged or defective items
Refunds are issued only after returned items are received and inspected

Initiating a chargeback without first contacting us may result in denial of future purchases and does not exempt you from our return requirements.

7. Third-Party Fulfillment & Services

Some products are fulfilled by third-party providers, including Printful. We are not responsible for:

Delays caused by third-party fulfillment partners
Carrier service interruptions
Packaging differences from third-party shipments

Third-party services may be subject to their own terms and policies.

8. Intellectual Property

All content on this site, including designs, logos, text, images, and graphics, is the exclusive property of Ninety Nine for the One Co. and may not be used without prior written permission.

9. Disclaimer of Warranties & Limitation of Liability

All products are provided “as is” and “as available,” to the fullest extent permitted by law.

Ninety Nine for the One Co. shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of our products or services.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Ninety Nine for the One Co. and its affiliates from any claims arising out of:

Your breach of these Terms
Your misuse of our products or website
Your violation of any applicable laws

11. Governing Law

These Terms shall be governed by the laws of the United States and the state in which Ninety Nine for the One Co. operates (Pennsylvania), without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to update these Terms at any time. Changes take effect immediately upon posting. Continued use of the site constitutes acceptance of the updated Terms.
